As used in this document, the term:

(1) “Service” means America’s Debate in its entirety, including content, creators, and staff members.
(2) “User” means any individual person who accesses the Service.
(3) “Agreement” means any and all terms and conditions outlined herein.

This document constitutes the Agreement between the User and the Service in its entirety. By using the Service, the User agrees to all terms and conditions set forth in the Agreement. This is a legally binding contract.

The User agrees to follow all rules as set forth in the Forum Rules and Guidelines. A link to the Rules appears at the top of every page throughout the Service.

The User is hereby notified that the Service is not responsible for any messages posted. The Service makes no warranties or representations in respect to the accuracy, completeness or usefulness of any message, and is not responsible for the contents of any message. The messages express the views of the author of the message, not the views of the Service.

Any User who feels that a posted message is objectionable is encouraged to use the ‘report this post’ link to notify the Service. The Service has the ability to remove objectionable messages and will make every effort to do so, within a reasonable time frame, if it is determined that removal is necessary.

The User agrees, through his/her use of the Service, that he/she will not use the Service to post any material which is knowingly false, defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented, threatening, invasive of a person's privacy, or otherwise in violation of any law. The User agrees not to post any copyrighted material, regardless of ownership.

The Service does not voluntarily release any private or personal information supplied to the Service to any third parties without warrant. User’s information will only be made available to government authorities upon court order acting within its proper jurisdiction or to facilitate the enforcement of the Agreement.

The Service retains the right to conduct internal discussions in order to facilitate the enforcement of the Agreement. The Service may consider any and all available pertinant information, regardless of origin or method of discovery.

The Service retains the right to refuse service to any User at any time.

In the event that the User is banned due to violation of the Agreement, the user agrees that all attempts by the User to access the Service in any form shall immediately cease and desist. If a banned User attempts to gain access to the Service, the Service maintains the right to pursue legal action to collect actual and punitive damages, and any costs and attorneys fees that may be incurred. The venue for any legal action resulting from this agreement shall be Chatham County in the state of Georgia.

The User hereby agrees that by submitting information to the Service, the User grants the Service the right to use any non-private information in Service’s advertisements, promotions, and products.

The Service retains the right to change or modify this Agreement at any time with notice via the "Announcements Forum". Banned members may request a copy of this Agreement by sending an email with the subject "Banned Member TOS Request" to bannedTOSrequest - AT - americasdebate.com.

Any further use of the Service constitutes acceptance of the Agreement.
