Three human rights organizations have recently reported abuses in the form of torture at US run facilities in Iraq.

Torture in Iraq 'worse than under Saddam' U.N. expert says torture in Iraq is "out of hand" I'm not seeking to debate whether we believe that torture is being used to coerce terrorists. That is a horse that's been beaten to death already, and is pointless, because the only people who truly know are those who are involved, and I don't particularly trust either side to tell the entire truth. The prisoners who are likely detained because they were insurgent fighters are going to make any accusations they can to make the US and democratic Iraq government look bad. I don't expect to hear the entire truth from our side, either because I suspect anything that's done falls under the auspices of national security and is kept very secret. What I'd like to debate is the following:
1. IF it is indeed found that the Bush Administration has permitted the use of torture in violation of international treaties, should President Bush be held accountable at the Hague as any war criminal? Why or why not?
2. If not in the international court, should he be held accountable under our own penal system in the US? Why or why not?
