This is a hoot. Carl’s Jr. (CKE Restaurants) is suing Jack in the Box over Jack’s ads making fun of the word “Angus”. IMHO, the Jack in the Box commercial arc with “Jack” were the best thing about the place (I can’t stand their food) and has done wonders for their business, but this latest ad is just…dumb. Dumb in the way movies aimed at adolescent boys is dumb (in other words, maybe I just don't "get" the toilet humor thing when paired with a food product sour.gif ).
QUOTE
CKE argues in the suit that the commercials falsely imply that Angus beef burgers come "from the rear-end and/or anus of beef cattle by creating phonetic and aural confusion between the words 'Angus' and 'anus."'
<snip>
The suit also says the ads mislead consumers by making an "apples to oranges" comparison between sirloin, which is a cut of beef, and Angus, which is a breed of cattle.

Tracey Erickson, vice president of trade group Certified Angus Beef, said Angus beef is considered high quality meat because Angus cattle produce juicier, more flavorful burgers.

The sirloin is a premium cut of beef that comes from the lower portion of a cow's ribs. Yahoo

I don’t care for Carl’s Jr. food either, so I can’t really make a comparison. So...

If Jack’s Sirloin Burger and Carl’s Jr.’s Angus Burger were to face off, who would win?

Who do you think will win the lawsuit?

I loves me an Angus burger - though, it's been about 6 months since I've had one. The only thing I ever liked from Jack in the Crack was their Jalapeno poppers.

Who do you think will win the lawsuit?
I haven't got any clue.

I don't normally eat at either place, I prefer Wendys and Burger King. I think Carl's makes better food than Jack does though.

As far as the lawsuit is concerned, what a ridiculous waste of our justice system's time. I don't know how any company who makes a commercial with Paris Hilton partially dressed can complain about someone else's commercials. rolleyes.gif It is a stupid lawsuit, probably designed more for publicity than anything else and I would hope the courts throw it out with some strong sanctions for filing it in the first place.

I remember a couple of years ago when Miller and Budweiser got into a commercial competition and that was fun! Each trying to out-create the other with their commercials. Bud won that one I think, but they have one of the best advertising strategies in the business. It was fun to watch though. Dueling commercials is the way to go, not lawyers in a court room.

laugh.gif I tend to agree. Carl's hasn't exactly taken the high road in their ads. Who can forget all the gloppy, drippy ketchup ads (the only one of which I liked was taken off the air - the one with the whole knife-wielding spooky shadow character and the suspenseful horror movie music)?

I really wanted to post the language directly from the lawsuit, because it was so ludicrous to see it in official legalese (translation: they're making it sound like "anus"!! laugh.gif ), but I wasn't able to do so.

Not as bad as the peanut butter lawsuit filed by a prisoner, but pretty darned close.
