OK, this is a confirmed bug over at Invision, considered to be the lowest priority...heh!
Do you actually type :'( or do you click the button? I could easily temporarily change the emoticon to make it use a different code.
Edit 2:
OK, I've temporarily changed the text command to trigger this emoticon. It is now:

Once they fix the code, I'll revert it to the old text command.
