This amendment was the strongest element in making abortion legal and teaching creation in the public schools illegal. Now it is illegal for states to forbid sodomy by statute. Is this amendment just whatever the Supreme Court wants it to be. The whole idea of it was to protect the rights of citizens (especially freed slaves) from state autonomy. I cant decide if they are recognizing inheriant rights or creating new law. .

The Civil War decided forever that the states are not soverign. They have to answer to the collective moral concensus of the union. With sodomy being illegal in 39 states this is clearly not the case here. I think that this buisness of privacy has been streched to the breaking point. This Supreme is getting entirely too proactive in its approach to civil rights. They are expanding their authority to create rights that did not exist before. Sodomy law struck down
