Hi I just found this site. My name is robert, nice to meet everyone. I have a little problem with my HOA...actually a big one.

On 20 September 2003 and car ran into our fence line, into the electrical transformer, and into our metal shed (which was there when we purchased the house which isn't compliant). The guy almost hit my wife as she was in the backyard only 10 feet away from where the truck entered. We went to the president of our HOA at the time to let him know about it (not that it could be missed) and told him the insurance company would be taking care of everything. He told us that was fine and just to let us know we couldn't replace the metal shed with another one (which we didn't want to do anyways); it had to be replaced with a wooden one that looks like the house. We asked him if there was anything else that we had to do and he said no. We talked a little longer and then went home. In October of 2003 everything was finally taken care of because the insurance company tried to blame us for it. In early November of 2003 the HOA sent us a letter stating that we had to give them information on the "new" building. We sent it in even though we shouldn't have had to because of Section 3.20 saying damaged property must be fixed or replaced or demolished fully in a reasonable amount of time. Well, now on 8 January 2004 I got a call from a guy who is on the HOA in our subdivision who said the shed is too tall, it can only be 8', bought 8'6" like we have. I explained what happened and he flat out said he didn't care that a car almost hit my wife and the metal shed was already there. The new shed isn't compliant. I read over the covenant and it says that the HOA has 30 days to contact us if there is a problem and anything after the 30 days it is fine. Well, he is telling my wife and I that we will have a lean put on our house if we do not take care of the height even though it is past the 30 days. Can someone help us? We don't want to cut down the shed's height unless we truly have to because of the covenant; but even in the covenant there is no height limit. Please help!!!
