Full Version: Using the Bible in sentencing

The state Supreme Court of Colorado ruled that a condemnation of a man to death will be overturned because the jury consulted the Bible's "eye for an eye" clause when they considered whether a man should live or die. Is the SC right to do this? Why, why not?

Isn't the jury just supposed to decide what happened, and isn't punishment supposed to be based on the law? I can't see how the Bible has to do with either.

Is the SC right to do this? Why, why not? I think they're definitely right. Jurors need to enforce the law, "an eye for an eye" isn't the law. If it was we would have arsonists burned at the stake. I have no problem with religious people being jurors but if you don't believe in following the law you shouldn't be a juror. It seems like this man was punished based on a passage in the bible, not the law. That's totally unfair. And doesn't the bible say "Thou shalt not kill" unsure.gif ?
